The Handout on the acceptable criteria for information about a lawyer and lawyer's office on the Internet

On December 21, the Council of the Moscow City Bar Association approved the Leaflet “Criteria for the admissibility of information about a lawyer and lawyer education posted on the Internet information and telecommunications network”.

Despite the criteria for the admissibility of the content of information about a lawyer and lawyer education, as enshrined in paragraph 1 of Article 17 of the Code of Professional Ethics of a Lawyer, as well as the Clarifications of the FPA RF Commission on Ethics and Standards on the application of this provision of the Code (Clarification of January 28, 2016 No. 03/16 and Clarification dated April 17, 2019 No. 01/19), the content of some websites of lawyers and lawyer formations has signs of violation of these requirements and unfair advertising.

The problem of unscrupulous advertising of advocacy on the Internet is one of the most urgent in the community. Placing on the Internet information that does not correspond to reality entails undermining confidence both directly in the lawyer who has disseminated false information about himself, and in the legal profession as a whole. Obviously, the existence of such sites is associated with the actions (inaction) of the lawyers themselves, who consciously allow the placement of information in an improper form in order to attract more clients, or do it unconsciously, guided by modern trends in behavior on the Internet. Such actions are a direct violation of the prohibition established by subparagraph 6 of paragraph 1 of Article 9 of the Lawyer's Code of Professional Ethics, and the requirements for information about the lawyer contained in paragraph 1 of Article 17 of the Lawyer's Code of Professional Ethics. If there are grounds, cases of posting information in this format become the subject of disciplinary proceedings.

The difficulty of identifying such facts is associated with a large number of lawyers and legal entities in the largest lawyer corporation - Moscow.

The objectives of the development of the "Reminder on the criteria for the admissibility of information posted on the Internet about a lawyer and / or a lawyer's education" (hereinafter referred to as the Reminder) are a reminder of professional and ethical requirements in this area, as well as protection of the professional rights of conscientious lawyers who do not consider it possible to use such tools in their activities.
